By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service and your subscription may be terminated at any time.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy and Community Guidelines of DataQG. Our Privacy Policy describes our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.
Rights and Limits
DataQG reserves the right the cancel your membership at any time. If on a monthly payment plan, no charges will be made to your account for the following month. If you are on a yearly plan, there will be no refund for the remainder of your subscription period which has been paid. The user will own all of the content, feedback, and personal information you have, content is granted a non-exclusive license to DataQG. DataQG has the right to restrict access to specific areas such as groups, discussions, or private sections within the platform. DataQG may suspend a user’s right to the platform at any time. You and DataQG agree that we may access, store, process and use any information and personal data that you provide in accordance with, the terms of the Privacy Policy and your choices (including settings)
Memberships/Billing:
A variety of Membership levels may be offered. We may offer a number of membership levels and plans, including special promotional plans or memberships with differing conditions and limitations. Any materially different terms from those described in these Terms of Use will be disclosed at your sign-up or in other communications made available to you.
Member is responsible for the usage of their subscription and profile. Sharing of login information and password to other members or non-members will be prohibited.
By beginning your DataQG membership, you authorize us to charge you a monthly/annual membership fee at the current rate. Your Payment Method for such varying amounts, which may be billed monthly in one or more charges. DataQG will contact members via email if there is a change to our membership fees prior to a change. Your payment will be applied unless canceled prior to the next billing cycle. Your billing cycle will begin at the time of application approval or the end of a free trial period. You will not receive a notice from DataQG when your free trial period has ended.
Your payment method automatically will be charged at the start of each subscription period. Taxes are included in the purchase. You will be sent an email invoice recipient once payment has been processed.
Proprietary Information
The material and content accessible from this platform, operated, licensed, or otherwise controlled by DataQG (the “Content”) is the proprietary information of DataQG or the party that provided or licensed the Content to DataQG whereby such providing party retains all rights, title, and interest in the Content. Accordingly, the Content may not be copied, distributed, republished, sold, uploaded, posted, or transmitted in any way without the prior written consent of DataQG. Sharing of content, screenshots, information, member data, reports, and videos is strictly prohibited. PDF documents provided by members and DataQG that offer the ability to download are an exception. You may not remove or alter, or cause to be removed or altered, any copyright, trademark, trade name, service mark, or any other proprietary notice or legend appearing on any of the Content. DataQG reserves all of its intellectual property rights in the Services. Trademarks and logos used in connection with the Services are the trademarks of their respective owners. DataQG, and “in” logos and other DataQG trademarks, service marks, graphics and logos used for our Services are trademarks or registered trademarks of DataQG.
The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of DataQG.
The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.
Our trademarks and trade address may not be used in connection with any product or service without the prior written consent of the Company.
Third-Party Information
The DataQG platform may have links to other sites which are not maintained by, or related to, DataQG. As a member, represent and warrant that you have read and agree to be bound by all applicable Terms of Use and policies for any third-party content and websites. DataQG has not reviewed all of such sites and is not responsible for the content of those sites. Links are to be accessed at the user’s own risk, and DataQG makes no representations or warranties about the content or accuracy of the sites linked. Members expressly hold and warrant DataQG harmless from any and all liability related to your use of third-party content. We respect the intellectual property rights of others. We require that information posted by Members be accurate and not in violation of the intellectual property rights or other rights of third parties.
Members do not have the right to post, including proprietary information or material from any third party, such as files containing software or other material protected by intellectual property laws (or by rights of privacy or publicity) DataQG holds zero liability for content posted by members. All content must adhere to the Community Guidelines.
Employment Status:
The DataQG Premium membership is for individuals on data teams at corporations, non-profits, government entities, or education firms. If a member is to become employed in the vendor space such as data governance software or service providers- DataQG has the right to end the membership at will. If Member has paid annual fees they will be refunded for the existing months on their annual subscription. If they are on a monthly subscription, there will be no refund and membership will be canceled.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall DataQG be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law. DataQG will not be liable to you in connection with this contract for the services during the term of this contract.
Your Content
Any posts, comments, documents, and activity created by the user within the platform can be deleted by the user during their active membership subscription. By providing video presentations and shared documents any specific content created such as DataQG dedicated blogs, presentations for the network, roundtables, and other DataQG-specific content is the property of DataQG. DataQG has the right to modify or delete content that doesn’t adhere to the community guidelines.
When you share content, information, or documents, other members have the ability to see and obtain this data. All members are paid customers who only have access to the platform post approval by DataQG. User is responsible for the content shared on the platform. Users must be cognizant of information that has copyright laws attached, along with proprietary information.
Termination
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.
Refunds
Once paid, the subscription fee for service is non-refundable All sales are final, and the DataQG does not offer any money-back guarantees. You recognize and agree that you shall not be entitled to a refund for any purchase under any circumstances. DataQG makes no warranties regarding the performance or operation of the platform.
Service Availability
DataQG may change, modify, or end any service within the platform at any given time. Prices for DataQG’s membership may change or modify. If there is an increase in price you will be notified prior to the renewal of your subscription. DataQg my delete content, information, or posts made by members. User agrees that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.
Restricted:
Is agrees they will not develop or use software, devices, scripts, or applications or other means or processes (including browser plugins, crawlers, and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services. Violate the IP rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights. Copy or sharing of information is strictly prohibited.
Changes to These Terms and Conditions
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
Miscellaneous
These Terms of Use will be governed and interpreted pursuant to the laws of Massachusetts, United States of America, notwithstanding any principles of conflicts of law. You specifically consent to personal jurisdiction in Massachusetts in connection with any dispute between you and DataQG arising out of these Terms of Use or pertaining to the subject matter hereof. The parties to these Terms of Use each agree that the exclusive venue for any dispute between the parties arising out of these Terms of Use will be in the state and federal courts in Boston, Massachusetts
Terms of Use constitute the entire agreement among the parties relating to this subject matter and supersedes all prior communications and proposals, whether electronic, oral, or written between the user and DataQG.
“AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of the course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error-free or that any errors or defects can or will be corrected.
Without limiting the foregoing, neither DataQG nor any of the company’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
